What personal data do we process, for what purpose, on what legal basis, and for how long is the personal data processed?
Kvdcars processes your personal data for the purposes set out in the tables below. For each purpose, Kvdcars must base its processing on a legal basis. A legal basis may be, for example, (i) your consent to the specific processing; (ii) that the processing is necessary for the performance of a contract to which you are a party; (iii) that the processing is necessary to comply with our legal obligations under, for example, laws or other regulations to which we are subject, or court or authority decisions requiring us to process data about you; or (iv) a balancing of interests where Kvdcars or a third party has a legitimate interest that outweighs your interest in your personal data not being processed. Purpose: Improving your experience of our website

Retention period: We process and store information about how visitors interact with our website for a maximum of six (6) months. In most cases, the collected personal data is converted into aggregated (anonymised) data before this period expires, as part of producing our statistics.

Retention period: Anonymised after six (6) months if no agreement has been signed.

Retention period: Anonymised eight (8) years (current year plus seven (7) years) after the most recent use of our services, and otherwise for the retention period required by law.
Purpose: Fulfilling legal obligations, e.g. initiated sale, bidding, purchase or sale.

Legal obligation.
This collection of your personal data is required to fulfil legal obligations. If the data is not provided, our legal obligation cannot be fulfilled and you will therefore not be able to use Kvdcars' services.
Balancing of interests.
We only use personal data that is relevant in each individual case to establish, exercise or defend legal claims and to handle customer complaints. This processing of your personal data is based on our legitimate interest in establishing, exercising or defending legal claims and handling customer complaints.
Retention period: Anonymised six (6) years after a signed agreement, submission of an item for sale, or the most recent bid or reservation (current year plus five (5) years). If you have bought or sold, the data is anonymised after eight (8) years (current year plus seven (7) years).
We may also process your personal data for a longer period in order to fulfil our legal obligations under, for example, laws or other regulations to which we are subject, or court or authority decisions requiring us to process data about you.
Purpose: Conducting market and customer surveys

Purpose: Otherwise providing, maintaining and managing our service

· Review of marketplace content in connection with preventing, investigating and taking action against misuse of our services, including fraud and other violations of our terms.

Balancing of interests.
The processing is necessary for our legitimate interest in administering and operating the business, taking action against misuse of our services, and establishing, exercising and defending legal claims.
Retention period: For general administration and IT support, data is as a rule retained for as long as the customer relationship or contact continues, or alternatively anonymised 2 years after collection. For the investigation of misuse and the handling of legal claims, the data is retained for as long as necessary (normally no longer than 10 years from when the data was registered).
Kvdcars processes personal data obtained directly from you when you become a member, otherwise enter into an agreement regarding our services, or otherwise use our services or our website, e.g. information you provide when registering interest, registering a membership or submitting information on Kvdcars' websites. We may also collect data about you from third parties, usually from the company or organisation you represent. Kvdcars also processes personal data obtained from the Swedish Transport Agency’s (Transportstyrelsen) register or suppliers, and from the finance company where you are a customer. Your personal data is updated from the Swedish Population Address Register (SPAR) via Bisnode.
In order for us to fulfil the purposes set out above, it is necessary for you to provide us with certain personal data. If you choose not to provide us with your personal data, we cannot meet our obligations to you, and as a consequence you will not be able to use our services. The data we need to process for you to be able to use our services is the data processed for the purposes of creating and administering your membership, performing the assignment, home delivery of vehicles, and fulfilling legal obligations. A complete list of this personal data can be found in the tables above.
To fulfil the purposes stated above, Kvdcars may share your personal data with the following recipients:
(a) other companies within the Kvdcars group, (b) IT suppliers, partners, marketing and research companies, finance companies, insurance companies and transport companies, and (c) authorities.
As a rule, we only process personal data within the EU/EEA. Should processing outside the EU/EEA become relevant in any case, we will ensure that the transfer takes place in accordance with applicable data protection legislation before the data is transferred, e.g. by ensuring that the recipient country meets the requirements for an adequate level of protection under a decision of the European Commission, or by ensuring that the transfer is covered by appropriate safeguards in the form of, for example, standard contractual clauses adopted by the European Commission, which ensure that appropriate measures are taken to safeguard the rights and freedoms of data subjects.

To keep the personal data we process secure, we have taken several security measures: we have implemented security procedures and technical and organisational measures to protect your personal data, such as ensuring that passwords cannot be read by anyone at Kvdcars and that forgotten passwords can only be reset via email with a specific reset link. All passwords are encrypted.
All communication, both external from Kvdcars and internal between systems, is encrypted. We also have appropriate firewalls and antivirus software to protect against and prevent unauthorised access to the network. Access to the premises where personal data is stored is restricted, and employees must be identified to gain access.
Below is a summary of the rights you have under European data protection legislation. Exercising these rights costs you nothing, and you can exercise them by contacting us (see contact details at the end of this privacy policy). Do not hesitate to contact us if you have any questions about your rights.
Please note that Kvdcars will always assess a request to exercise a right in order to determine whether the request is justified. Not all of the rights listed below are absolute, and exceptions may apply.
In addition to the rights listed below, you always have the right to lodge a complaint with a supervisory authority regarding Kvdcars' processing of your personal data. In Sweden, the Swedish Authority for Privacy Protection (Integritetsskyddsmyndigheten, IMY) is responsible for supervising the application of applicable data protection legislation.
(a) Right of access. On request, you are entitled to receive a copy of the personal data about you that Kvdcars processes (a so-called register extract), as well as supplementary information about Kvdcars' processing of your personal data.
(b) Right to rectification. You have the right to have your personal data corrected and/or completed if it is inaccurate and/or incomplete.
(c) Right to erasure. You have the right to request that Kvdcars erase your personal data without undue delay in the following situations: the personal data is no longer necessary for the purposes for which it was collected or otherwise processed; you withdraw your consent to the processing and there is no other legal basis for the processing; you make a justified objection to the processing of your personal data; the personal data has been processed unlawfully; or erasure is required to comply with a legal obligation.
Clarification regarding Kvdcars:
Kvdcars always erases personal data on request, as long as there are no legal obligations or contractual commitments requiring the data to be retained. This means, for example, that we cannot erase information linked to purchases, sales or bidding via Kvdcars, as such information must be retained under applicable legislation and our obligations to authorities such as the Swedish Tax Agency (Skatteverket). In these cases, the data is stored for the retention periods stated.
(d) Right to restriction of processing.
You have the right to request restriction of the processing of your personal data in the following situations:
- the accuracy of the personal data is under investigation;
- the processing is unlawful or no longer necessary for the purposes of the processing, but you oppose erasure of the personal data and request restriction of processing instead;
- Kvdcars no longer needs the personal data, but you need it to establish, exercise or defend legal claims;
or
- you have objected to the processing of your personal data and the objection is under investigation.
(e) Right to data portability. In certain circumstances, you have the right to receive the personal data concerning you that you have provided to Kvdcars in order to transfer it to another service provider, if the processing of the personal data is based on your consent or the performance of a contract.
(f) General right to object. You have a general right to object at any time to processing of your personal data that is based on Kvdcars' legitimate interest. If you object, we must demonstrate that we have compelling legitimate grounds for such processing or that we need the personal data to establish, exercise or defend legal claims.
(g) Right to object to direct marketing. You have the right to object at any time to the processing of your personal data for direct marketing purposes. If you do so, Kvdcars will no longer process your personal data for such purposes.
